EEO Complaint Process

The Office of the Comptroller of the Currency (OCC) is an equal opportunity employer. If you are an employee or applicant for employment and feel that you have been discriminated against, you may have the right to file a complaint of discrimination with the Department of the Treasury. The EEO complaint process may be utilized for allegations of discrimination based on race, color, religion, national origin, sex, age (40 yrs and older), disability (physical and mental), protected genetic information, sexual orientation, and parental status*.

If you believe that unlawful discrimination has occurred, you must initiate the EEO pre-complaint process by contacting the OCC's EEO office within 45 calendar days of the alleged discriminatory event. All federal applicants and employees must complete the EEO pre-complaint process before filing a formal EEO complaint. A neutral third party (i.e., EEO Counselor) will be assigned to identify the allegation and agency response, as well as attempt an early resolution of the matter. The pre-complaint process should not exceed 30 days; however, you may agree to an extension up to an additional 60 days. If a resolution is not achieved during the pre-complaint process, a notice of the right to file a discrimination complaint will be issued by the EEO office. The formal complaint must be filed within 15 calendar days of receipt of the notice. *Complaints of discrimination based on sexual orientation and parental status, although not covered by the laws prohibiting discrimination, may be pursued under OCC's and Treasury's administrative procedures, however there are no further appeal rights beyond a decision by the Department.
